Terms and Conditions (T&C)
1. Scope & Contractual Partner
These Terms and Conditions apply to all orders placed by consumers (§ 13 of the German Civil Code, BGB) in our online shop INSANIFY. Deviating terms shall not apply unless we have expressly agreed to their application.
Your contractual partner is INSANIFY; the full provider address is available in the Legal Notice (referred to below as “we” or “us”).
2. Conclusion of Contract & Ordering
The presentation of products in the online shop does not constitute a legally binding offer, but is an invitation to place an order. You may add items to your basket without obligation and correct your entries at any time before submitting a binding order.
By clicking the order button you make a binding offer. The contract is concluded when we accept the order by sending an order confirmation by email.
Immediately after submitting your order you will receive an automated email (order acknowledgement) which does not yet constitute acceptance.
3. Prices, Shipping & Taxes
All prices are final prices. As a small business under § 19 of the German VAT Act, no VAT is charged. Any shipping costs are shown separately at checkout. Information on shipping methods, costs and regions is available here.
4. Payment Methods & Due Date
Only the payment methods actually displayed at checkout are available. Payment is due immediately upon conclusion of the contract. Any fees charged by your payment service provider are borne by you.
5. Delivery, Lead Times & Availability
We deliver to the countries selectable at checkout. Estimated delivery times are shown on the product page or at checkout and on our shipping page. Partial deliveries are permitted where reasonable; you will not incur additional shipping costs as a result.
Note on colour rendering: Minor colour deviations between on-screen display and the printed original may be technically unavoidable and do not constitute a defect.
6. Right of Withdrawal & Returns
Consumers have a statutory right of withdrawal. The withdrawal instructions and the model withdrawal form will be provided to you on a durable medium (e.g. by email).
Exceptions: The right of withdrawal does not apply to goods manufactured according to customer specifications or clearly personalised (e.g. custom prints / bespoke sizes) and, under certain conditions, to digital content where you have expressly consented to us commencing performance before the withdrawal period has expired.
Unless otherwise stated, you bear the direct cost of returning the goods.
7. Warranty & Guarantees
Statutory warranty rights apply. Any additional manufacturer guarantees only apply where expressly stated; their terms can be found on the respective product page.
8. Liability
We are fully liable for wilful intent and gross negligence and for injury to life, body or health. For slight negligence in breach of material contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for such contracts. Otherwise, liability is excluded.
9. Retention of Title
The goods remain our property until full payment has been received.
10. Vouchers, Promotions & Discount Codes
- Unless otherwise stated, vouchers are redeemable within the validity period specified.
- Cash payout is excluded; any remaining balance is credited back to the voucher.
- Discount codes cannot be combined unless expressly stated otherwise.
11. Copyright & Rights of Use (Motifs / Downloads)
All motifs, designs and content are protected by copyright. With your purchase you generally acquire only the physical product or, for digital content, a simple right of use for private purposes. Any further use (e.g. reproduction, commercial use) requires our prior consent.
12. Customer Information (Contract Text, Language, Corrections)
- Contract language: German. The English version of these Terms is provided for information purposes; in case of doubt the German version prevails.
- Storage of the contract text: We store the contract text and send you the order details together with these Terms by email. Past orders can be viewed in your customer account (if created).
- Correcting entries: Before submitting your order you can change your entries in the basket / at checkout at any time. Browser functions (back button) will assist you.
13. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
If the customer is a merchant, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction shall be our registered seat.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
